(Eng/ Fre.) Montreal woman appeals Quebec judge’s refusal to issue declaratory judgement on hijab in court/ Une Montréalaise interjette appel du refus d’un juge du Québec de rendre un jugement déclaratoire sur le port du hijab dans un tribunal

(Montreal – November 23, 2016) A Montreal woman prevented from appearing in court with a hijab is appealing a ruling of a Quebec superior court judge which denied her request for a declaration that she has a right to wear her it in Court. In a ruling issued last month, Justice Wilbrod Decarie wrote that Judge Eliana Marengo’s requirement that Ms. El-Alloul remove her headscarf before hearing her case was against the law. However, he deemed it unnecessary and outside his jurisdiction to issue a general declaratory ruling on the issue of religious attire in the courts. The ruling has important potential consequences because it means that ...

Quebec’s bill on religious neutrality is anything but

By Mihad Fahmy Montreal Gazette | November 13, 2016 If there’s one thing that’s crystal clear from the hearings on Quebec’s proposed legislation on religious neutrality, it’s that many Quebec organizations fail to see its need, albeit for differing reasons. For the past few weeks, Quebec has been holding public hearings into the provincial government’s Bill 62, “An Act to foster adherence to State religious neutrality and, in particular, to provide a framework for religious accommodation requests in certain bodies.” The hearings concluded last week. First introduced over a year ago, the bill attempts to codify (with some ...
